Terms of Service

1. Acceptance

By downloading, installing, or using the TVCanvas iOS app ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app.

2. License

TVCanvas grants you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, in accordance with Apple's App Store Terms of Service. You may not redistribute, reverse-engineer, or modify the app except as permitted by applicable law.

3. AI-generated content

The app generates and transforms images using third-party AI providers. AI output may be inaccurate, biased, or unexpected. You are responsible for how you use generated content, including compliance with copyright, publicity, and any applicable laws. Do not use the app to generate content that infringes the rights of others or violates the policies of the underlying AI provider.

4. Third-party services

Some features require third-party services (OpenAI, Google Gemini, Apple Intelligence, TVCanvas Cloud). When you use such features, you are also bound by the terms and privacy policies of the respective provider. TVCanvas is not responsible for the availability, accuracy, or content of third-party services. When you supply your own API key, you are responsible for any costs incurred with that provider.

5. TVCanvas Cloud credits

TVCanvas Cloud is an optional managed-generation service billed in credits. Credits are purchased in-app via Apple's In-App Purchase system. Credits are non-refundable except where required by applicable law (including Apple's refund process). Credits may expire as disclosed at the point of purchase.

6. Acceptable use

You agree not to:

• Use the app to generate or distribute content that is unlawful, harassing, defamatory, or that infringes the rights of others.
• Attempt to circumvent rate limits, credit allocation, or other access controls.
• Interfere with or attempt to compromise the integrity of the app, TVCanvas Cloud, or other users' use of the app.

7. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. TVCanvas does not warrant that the app will be uninterrupted, error-free, or compatible with all TV models or receivers.

8. Limitation of liability

To the maximum extent permitted by law, TVCanvas and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including loss of data, loss of profits, or damage to TVs or other connected hardware. Total liability for any claim shall not exceed the amount you paid for credits in the six months preceding the claim, or USD $10, whichever is greater.

9. Termination

TVCanvas may suspend or terminate access to TVCanvas Cloud for violation of these Terms, including unpaid credits or abuse of the service. You may stop using the app at any time by uninstalling it.

10. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of laws principles. Disputes arising under these Terms shall be resolved exclusively in the courts located in King County, Washington, and you consent to that jurisdiction and venue.

11. Changes to these Terms

TVCanvas may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
